Fahda Nur specializes in civil (general, corporate and commercial) litigation and Islamic law practice. Fahda is the managing partner and founder of the firm, Fahda Nur & Yusmadi in Petaling Jaya, Selangor. She received her LL.B. from the International Islamic University Malaysia (2000) and later pursued her LL.M. at the University College London, United Kingdom (2003-2004). In 2003, Fahda was awarded the prestigious British Chevening Scholarship to pursue her LL.M. at the University College London in UK. Upon graduation, she was awarded the coveted Sir Jack Jacob QC Prize for her Distinction in Civil Litigation. Fahda was called to the Malaysian Bar as an Advocate & Solicitor in 2001.

Background

Fahda’s strong academic performance in law school earned her the Best Law Student Award, President’s Award for activities and achievements at the national and international level and the Overall Best Student Award from the International Islamic University in year 2000. She was the former Best Speaker and Asian Champion at the All-Asians Intervarsity Debating Championship in 1998, three-time National champion for English debates and Malaysian representative to the Phillip C. Jessup International Law Moot Court Competition, in Washington D.C. Her varied activities earned her the National Youth Award 1999 and she was subsequently selected to be a recipient of the Commonwealth Youth Award in 1999.

Legal Practice

Fahda’s practice spans diverse areas of the law, aimed at supporting a broad spectrum of her client’s needs. Fahda was formerly an associate at two prominent law firms, Messrs. Zain & Co. (2000-2003) and Messrs. Tommy Thomas (2006-2008). Having read in the chambers of the former Malaysian Bar President, Datuk Haji Sulaiman Abdullah, Fahda had the privilege of being trained by one of the best lawyers in the industry and was formerly co-counsel to Haji Sulaiman Abdullah and Tommy Thomas

Diligent, resourceful and persistent, Fahda has represented individuals, chairman of companies, CEOs and mid-size institutions, major and multi-national corporations at all phases of court proceedings. An experienced court Barrister, Fahda has also appeared at all levels of the court, be it the Subordinate Courts or the Appellate Courts, be they civil and commercial proceedings or syariah cases.

No stranger to complex and contentious disputes, the firm’s commercial litigation team was appointed to defend a 1.01 billion compensation claim in relation to a tri-partite concession agreement, which was filed against a state government. Fahda’s meticulous and thorough approach has resulted in the firm being entrusted to handle many complex disputes, leading to trial and all the way up to the Appellate courts. As a trial lawyer, Fahda has initiated and defended many civil and commercial claims. She also has secured a memorable win, for breach of an oral contract, resulting in a landmark sale and seizure proceedings against a municipal council.

Her wide and varied exposure to complex litigation includes debt recovery of one of the largest personal loan in Malaysian history, RM 1.97 billion in a landmark legal dispute; ensuring regulatory compliance by the Securities Commission of Malaysia through civil action, action in Industrial Court on behalf of claimants and companies and many highly contentious divorce, probate and administration of estate disputes and other real estate claims.

Fahda’s personal interest include Islamic-related disputes and she has been involved in many high-profile matrimonial and property disputes. Fahda is a certified syariah lawyer for the states of Wilayah Persekutuan, Selangor, Negeri Sembilan and Pulau Pinang. Fahda also takes special interest in matters relating to conflict of laws and has taken briefs involving the dual and overlapping jurisdictions of the Civil and Syariah courts in Malaysia. She also has experience litigating Islamic Banking cases, including fielding challenges to products and defending the enforceability of Islamic finance contracts. Fahda recently contributed a chapter on “Legal Framework for Islamic Finance” in the textbook “Islamic Finance-principles & Operations” (2nd Ed.) published by the International Shariah Academy for Islamic Finance (ISRA). She was also a contributor to the book “The Road to Reform” (2009) and author to the book “Freedom of Information” (2006).

Fahda Nur’s experience spans across borders and she has handled many disputes involving foreign jurisdictions, worked with foreign law firms and advised clients in Australia, United Arab Emirates, United Kingdom, Singapore, Indonesia Japan and Germany.

Fahda Nur was named Member of the Order of the Crown of Selangor, (Ahli Mahkota Selangor) by Sultan Sharafuddin Idris Shah Al-Haj Ibni Almarhum Sultan Salahuddin Abdul Aziz Shah Al-Haj, Sultan of Selangor in December 2017.
